TERMS Last updated: 16 September 2026 1. ABOUT THESE TERMS These Terms govern your use of the Luxtag website and your interactions with Luxtag Ltd (“Luxtag”, “we”, “us” or “our”). By using our website or asking Luxtag to assist with an enquiry, you agree to these Terms. Additional terms may apply to particular services and will be communicated where appropriate. 2. ABOUT LUXTAG Luxtag provides private aviation sourcing, travel and concierge assistance and private membership services. For private aircraft charter and many travel or concierge services, Luxtag acts as an intermediary between the client and independent third-party service providers. Unless expressly stated otherwise, Luxtag does not own or operate aircraft and is not an air carrier. Aircraft operations are performed by appropriately authorised third-party aircraft operators. 3. PRIVATE AVIATION ENQUIRIES When you request a private flight through Luxtag, we may source suitable charter options from independent aircraft charter providers or operators based on the information and requirements you provide. Any quotation or availability communicated before a booking is confirmed is subject to availability and the relevant provider's final confirmation. Aircraft, schedules, airports, pricing and other details may change before confirmation. A request or enquiry submitted to Luxtag does not itself constitute a confirmed aircraft booking. 4. CONTRACT WITH THE AIRCRAFT PROVIDER Where Luxtag introduces or arranges a private aircraft charter supplied by a third-party provider, the contract for the flight will normally be between you and the relevant aircraft provider or operator, as identified during the booking process. Payment for the aircraft charter will be made directly to the relevant provider unless expressly agreed otherwise in writing. The flight will also be subject to the provider's applicable booking, charter, cancellation and carriage terms. You should review those terms carefully before confirming a booking. 5. PRICING AND PAYMENT Prices for private aircraft charter are determined by the relevant provider and may depend on factors including aircraft availability, route, airports, dates, operating requirements and other circumstances. Unless expressly stated otherwise, quotations are not guaranteed until the relevant provider confirms the booking. Payments relating to third-party services are normally made directly to the relevant provider in accordance with that provider's payment terms. Any fee charged directly by Luxtag will be clearly communicated before you agree to incur that fee. 6. CHANGES AND CANCELLATIONS Changes or cancellations to private aircraft charter or other third-party services are subject to the terms of the relevant service provider. Charges may apply depending on the provider's terms, the timing of the change or cancellation and costs already incurred. Luxtag will assist with communicating requested changes or cancellations to the relevant provider but cannot guarantee that a provider will accept a change or issue a refund. Nothing in these Terms affects any rights you may have under applicable consumer law. 7. AIRCRAFT AND OPERATIONAL CHANGES Private aviation is subject to operational considerations including weather, airport restrictions, air traffic control, aircraft availability, crew availability, technical matters, safety requirements and regulatory requirements. The relevant aircraft operator is responsible for the safe operation of the flight and has final authority over operational and safety decisions. Where an aircraft, schedule, airport or other element of a booking needs to change, Luxtag will assist in communicating with the relevant provider and, where appropriate, sourcing alternatives. 8. TRAVEL AND CONCIERGE SERVICES Luxtag may assist with arranging services including accommodation, ground transportation, yachts, restaurants, experiences and other travel or lifestyle requests. Unless expressly stated otherwise, these services are provided by independent third-party suppliers. Bookings may therefore be subject to the relevant supplier's own terms, availability, payment requirements, cancellation policies and restrictions. We will make reasonable efforts to communicate material conditions that are provided to us and relevant to your booking. 9. CLIENT INFORMATION AND RESPONSIBILITIES You are responsible for providing accurate and complete information when making an enquiry or booking. This includes passenger names, contact details, travel dates, passport or travel information where required, and any requirements that may affect the service. Passengers are responsible for ensuring they hold appropriate passports, visas, travel documentation and permissions required for their journey unless expressly agreed otherwise. You should notify Luxtag promptly if any information or requirement changes. 10. THIRD-PARTY PROVIDERS Luxtag carefully sources providers appropriate to a client's request, but independent providers remain responsible for delivering their respective services. Luxtag is not responsible for the acts or omissions of an independent provider except to the extent that responsibility cannot lawfully be excluded or where Luxtag itself has failed to exercise the care and skill required by applicable law. Nothing in these Terms excludes or limits liability where doing so would be unlawful. 11. PRIVATE MEMBERSHIP Luxtag Private Membership is a separate ongoing service and is available by application, referral or private invitation. Membership is subject to acceptance by Luxtag and may be governed by separate membership terms provided before a membership is entered into. Submitting a membership enquiry or application does not guarantee acceptance. 12. WEBSITE INFORMATION We take reasonable care to ensure information on our website is accurate, but website content is provided for general information and may change. Aircraft imagery, destinations, examples and descriptions displayed on the website are illustrative unless expressly stated otherwise and do not guarantee the availability of a particular aircraft, property, service or experience. Nothing displayed on the website constitutes a confirmed booking or guarantee of availability. 13. INTELLECTUAL PROPERTY The content, branding, design, text and other materials on this website are owned by or licensed to Luxtag unless otherwise stated. You may not reproduce, distribute or commercially exploit website content without our prior written permission, except where permitted by law. 14. PRIVACY AND COOKIES Our collection and use of personal information is explained in our Privacy Policy. Information about cookies and similar technologies used on our website is provided in our Cookie Policy. 15. LIABILITY Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Where Luxtag provides services directly, we will perform those services with the care and skill required by applicable law. Independent service providers are responsible for the services they contract to provide to you. Nothing in these Terms affects your statutory rights as a consumer. 16. CHANGES TO THESE TERMS We may update these Terms from time to time to reflect changes to our services, business practices or applicable requirements. The latest version will be published on this website with the relevant “Last updated” date. 17. GOVERNING LAW These Terms are governed by the laws of England and Wales. Nothing in this section deprives a consumer of any mandatory rights or protections available under applicable law. 18.
